Terms of Service

Effective date: 18 October 2026  ·  Contact: hello@ebbchart.com

1. About these terms

These terms govern your use of the EbbChart app and the services behind it. By creating an account or using EbbChart, you agree to them.

EbbChart is operated by David McAvinue, an individual based in Cork, Ireland ("we", "us"). How we handle your personal data is described separately in our Privacy Policy, which forms part of these terms.

If you do not agree to these terms, please do not use EbbChart.

2. EbbChart is not a medical device or medical advice

EbbChart is a personal tracking tool. It records and displays hearing test results and other information you provide, so you can see how they change over time and share them with your clinician.

EbbChart does not diagnose, treat, cure, monitor for clinical purposes, or prevent any condition. It is not a medical device and has not been clinically validated. It does not tell you what your results mean, whether a treatment is working, or what you should do.

Always seek the advice of a qualified clinician about your hearing and health. Never delay seeking care, or disregard professional advice, because of anything you see in EbbChart. If you notice a sudden change in your hearing, seek medical care promptly. Sudden hearing loss can be time-sensitive.

3. Who can use EbbChart, and your account

You must be 18 or older to use EbbChart.

You are responsible for keeping your sign-in details secure and for activity under your account. Tell us at hello@ebbchart.com if you think someone else has accessed it.

Please give accurate information when you create your account and keep it up to date. Your account is personal to you; do not share it or create one for someone else without their permission.

4. Your data

Your hearing results, symptom logs, medication courses and other information you add remain yours. You give us permission to store and process them only to provide EbbChart to you, as described in the Privacy Policy.

EbbChart cannot work without processing health information. When you set up EbbChart, we ask for your explicit consent to process your hearing and health data. You can withdraw that consent at any time by deleting your account (see section 13).

We do not sell your data and do not use it for advertising. You can export your data from the Share tab at any time.

5. Accuracy of results

EbbChart shows results from three kinds of source: tests taken in the app, results imported from Apple Health, and clinic audiograms you enter. Each is labelled with its source.

In-app and Apple Health results come from consumer devices. They vary with headphones, device, background noise and how the test is taken, and are not equivalent to calibrated clinical audiometry. They are suited to seeing change over time, not to establishing an exact hearing level.

We display what was recorded and do not alter measured values. We cannot guarantee the accuracy of results produced by Apple Health, other apps or your devices, and we are not responsible for errors in data you or they provide.

6. Connected AI assistants

You can choose to connect EbbChart to a third-party AI assistant, currently Claude by Anthropic, so it can read your EbbChart data and answer questions about it. This is optional and off by default.

When you connect an assistant, data it reads is sent to that provider and is governed by the provider's own terms and privacy policy, not ours. Its answers are generated by the provider, not by EbbChart. We are not responsible for what an assistant says, and its output is not medical advice.

You can disconnect at any time from Profile → Connected AI assistants, or from the assistant's own settings. Deleting your EbbChart account also ends the connection.

7. Research participation

You can choose whether to make your data available for future research into the conditions EbbChart tracks. It is optional, off by default, and has no effect on your use of EbbChart. The terms of that choice, including how your data would be de-identified and how to withdraw, are set out in the research consent shown in the app and in the Privacy Policy.

8. Tips

EbbChart is free. You can choose to leave a tip through an in-app purchase to help cover running costs. A tip is a voluntary contribution: it does not unlock features, buy priority support, or create any further obligation on us.

Tips are processed by Apple. Refunds are handled under Apple's refund policies; nothing in these terms affects your statutory rights as a consumer.

9. Acceptable use

Please do not:

We may suspend or close an account that breaks these rules, and will tell you why unless the law or security prevents it.

10. Intellectual property and your licence

The EbbChart app, its design, software and name belong to us. We give you a personal, non-exclusive, non-transferable licence to use the app on Apple devices you own or control, for your own non-commercial use, in line with these terms and Apple's Usage Rules.

Reports and exports you generate from your own data are yours to use and share as you wish.

11. Availability and changes to EbbChart

EbbChart is developed and run by one person. We aim to keep it available and working well, but cannot promise it will always be uninterrupted or error-free.

We may change, add or remove features. If we decide to stop providing EbbChart altogether, we will give you at least 30 days' notice in the app and the chance to export your data first.

12. Our liability to you

Nothing in these terms limits or excludes liability that cannot be limited or excluded by law, including liability for death or personal injury caused by negligence, for fraud, or your statutory rights as a consumer.

Subject to that, EbbChart is provided free of charge and as a tracking tool only. We are not liable for:

Where we are otherwise liable, our total liability to you is limited to the greater of the amount you have paid us in tips in the 12 months before the claim and €50.

13. Ending your use and deleting your account

You can stop using EbbChart at any time. To delete your account and all your data, go to Profile → Delete account. Deletion is permanent and cannot be undone. If you signed in with Apple, you can also remove EbbChart from Settings → [your name] → Sign-In & Security → Sign in with Apple.

We may close your account if you seriously or repeatedly break these terms, or if we stop providing EbbChart (see section 11). Sections 2, 5, 12 and 15 continue to apply after your account ends.

14. Changes to these terms

We may update these terms as EbbChart develops. We will change the effective date at the top. If a change materially affects you, we will tell you in the app before it takes effect and ask you to review it. If you do not agree, you can delete your account before the change applies.

15. Law, Apple, and contact

Governing law. These terms are governed by the laws of Ireland. If you live in the EU, you also keep the protection of the mandatory consumer laws of your country, and may bring a claim in the courts of your country or Ireland.

Apple. These terms are between you and us, not Apple. Apple is not responsible for EbbChart or its content and has no obligation to provide maintenance or support for it. To the extent permitted by law, Apple has no other warranty obligation for EbbChart; if the app fails to meet an applicable warranty, you may notify Apple, which may refund the purchase price (if any). We, not Apple, are responsible for handling any claims relating to EbbChart, including product liability, legal or regulatory compliance, consumer protection, and intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm you are not located in a country subject to a US Government embargo and are not on any US Government list of prohibited or restricted parties.
